When Almost Every Treatment Failed: Medical Reality of the Mushroom Poisonings

In this extra episode, we go through testimony at Erin Patterson’s murder trial. Professor Stephen Warillo from The Austin Hospital in Melbourne reveals the devastating details of how three victims died from organ failure despite maximum medical intervention after allegedly consuming death cap mushrooms. The Erin Patterson murder trial hears how Donald and Gail Patterson and Heather Wilkinson died while Ian Wilkinson narrowly escaped death following the suspected mushroom poisoning at a family lunch.

• Donald Patterson suffered "severe liver injury and severe liver failure" before receiving a liver transplant that ultimately failed
• Heather Wilkinson was deemed too unwell for a transplant as her condition was "not survivable"
• Ian Wilkinson, the sole survivor, received a liver transplant and slowly recovered despite doctors believing he would die
• Gail Patterson experienced advanced organ failure with her liver "essentially not working at all"
• Medical teams attempted extraordinary measures including plasma exchange and vitamin C treatments
• All three victims experienced multiple organ failure described as "refractory" to treatment

00:00:00.040 --> 00:00:06.605
During Erin Patterson's triple murder trial last week, there was a moment where many just froze in shock.

00:00:06.605 --> 00:00:18.893
Intensive care specialist Professor Stephen Warillo was giving evidence about the efforts at the Austin Hospital to save the lives of those who attended the mushroom lunch.

00:00:18.893 --> 00:00:26.495
It was a confronting and raw testimony, but mostly it was sad, devastatingly sad.

00:00:26.495 --> 00:00:31.484
Welcome to a bonus edition of the Mushroom Murder Trial Podcast.

00:00:31.484 --> 00:00:35.734
I'm Lisa and I've been reporting every day of this trial.

00:00:35.734 --> 00:00:41.387
It's 3am here and I figure I'd rather report this episode.

00:00:41.387 --> 00:00:44.773
It's much better than tossing and turning all night.

00:00:44.773 --> 00:00:46.534
Now just a refresher.

00:00:46.534 --> 00:00:52.914
The defendant is Erin Trudy Patterson, age 50, of Leangatha in Victoria.

00:00:52.914 --> 00:01:00.276
The charges are three counts of murder and one count of attempted murder, and the plea is not guilty.

00:01:00.276 --> 00:01:10.605
She's saying that it was a terrible accident, but at the heart of this case is also the four lunch attendees, three of whom died.

00:01:10.605 --> 00:01:24.012
On July 29, 2023, during a family gathering, ms Patterson allegedly served a homemade beef wellington containing the deadly toxins from the death cap mushroom.

00:01:24.012 --> 00:01:34.256
Within days, three members died Don and Gail Patterson, both aged 70, and Heather Wilkinson, who is aged 66.

00:01:34.256 --> 00:01:37.786
Her husband, ian, fell critically ill but survived.

00:01:38.688 --> 00:01:43.724
Now I'm going to read in detail some of what we heard in the Supreme Court of Victoria last week.

00:01:43.724 --> 00:01:47.152
Just a warning, it's graphic at times.

00:01:47.152 --> 00:01:58.733
Now we're talking about Donald Patterson here, when he arrived at the Austin Hospital and the prosecutor is asking the professor questions about it.

00:01:58.733 --> 00:02:04.266
Prosecutor, what was Donald Patterson's condition when he arrived at the Austin?

00:02:04.266 --> 00:02:09.748
Professor, he was critically ill and in multiple organ failure.

00:02:09.748 --> 00:02:12.841
I can go into more detail, prosecutor.

00:02:12.841 --> 00:02:17.953
Perhaps there were various blood tests which indicated he was critically unwell.

00:02:17.953 --> 00:02:26.635
Professor, yes, so we identified that he's had a severe liver injury and severe liver failure.

00:02:26.635 --> 00:02:36.300
Measurement of specific substance in the blood, such as, were extremely high, consistent with a severe or massive liver injury.

00:02:36.300 --> 00:02:39.745
We also saw his blood clotting.

00:02:39.745 --> 00:02:52.953
Measurements were grossly abnormal, consistent with liver failure, and he had a range of other abnormalities, including a buildup of acid in the blood and a buildup of ammonia in the blood.

00:02:53.699 --> 00:02:57.651
Was Donald Patterson receiving various treatments when he arrived at the Austin?

00:02:57.651 --> 00:02:59.581
Yes, he was.

00:02:59.581 --> 00:03:05.334
Our colleagues at Dandenong had already commenced a range of treatments to try and help support him.

00:03:05.334 --> 00:03:09.067
Was he sedated and intubated?

00:03:09.067 --> 00:03:10.109
That's correct.

00:03:10.109 --> 00:03:26.852
Yes, so in an induced coma he was on a breathing machine, so on life support, ventilation with a tube down into his windpipe through his mouth and receiving medication to assist his comfort during that time.

00:03:28.219 --> 00:03:53.514
Now were various tests carried out to try and pinpoint the cause of Donald's acute liver failure, and they go into some tests here, as well as some imaging and ultrasounds, to try and test for specific viruses that can cause liver failure, to try and make sure there wasn't another possible cause for why he was so sick During that period.

00:03:53.514 --> 00:03:56.401
Was something called an ileus suspected?

00:03:56.401 --> 00:04:02.337
Yes, it's a medical term where the bowel is extremely unwell and essentially stops working.

00:04:02.337 --> 00:04:05.580
The normal function of the bowel ceases.

00:04:05.580 --> 00:04:10.780
Did Donald Patterson undergo surgery on August 4, 2023?

00:04:10.780 --> 00:04:11.703
He did.

00:04:12.290 --> 00:04:21.456
After extensive consultation with a range of senior specialists, it was thought that the only possibility of saving his life was through a liver transplant.

00:04:21.456 --> 00:04:23.074
Did that occur?

00:04:23.074 --> 00:04:27.701
Yes, there was an effort to undertake and complete a liver transplant.

00:04:27.701 --> 00:04:33.617
After the liver transplant was carried out, did Donald Patterson's condition improve?

00:04:33.617 --> 00:04:37.677
No, he got relentlessly worse, unfortunately.

00:04:37.677 --> 00:04:45.141
Was it recognised through the day that Donald Patterson was dying despite maximal therapy?

00:04:45.141 --> 00:04:55.733
Yes, all our treatments had unfortunately failed and help was dying despite all of the measures that we were applying.

00:04:55.733 --> 00:05:03.562
Did clinicians conclude that no other treatment options would help Donald and this was non-survivable for him?

00:05:03.562 --> 00:05:06.471
We had no other treatments to offer.

00:05:06.471 --> 00:05:10.298
There was no other therapies and it was so.

00:05:10.298 --> 00:05:11.540
Yeah, he was dying.

00:05:11.540 --> 00:05:14.471
And did he ultimately pass away?

00:05:14.471 --> 00:05:16.615
At 11.30pm on the 5th of August?

00:05:16.615 --> 00:05:18.360
That's what I recall.

00:05:18.360 --> 00:05:30.444
Yes, and that was due to refractory multiple organ secondary to acute liver failure due to clinically diagnosed mushroom poisoning.

00:05:31.310 --> 00:05:41.810
Now we're going to move on to Heather Wilkinson, and the prosecutor asks how was her condition by August 2 2023?

00:05:41.810 --> 00:05:49.165
She had a rapidly progressive deterioration of her multiple organ failure.

00:05:49.165 --> 00:05:54.937
Was a decision made to list her for an emergency liver liver transplant?

00:05:54.937 --> 00:05:58.142
There were discussions about whether it would be possible.

00:05:58.142 --> 00:06:00.552
Yes, was it possible?

00:06:00.552 --> 00:06:08.797
Ultimately, no, she was too unwell to undergo the complex and extensive surgery required for a liver transplant.

00:06:08.797 --> 00:06:13.670
It was very apparent that this is not survivable.

00:06:13.670 --> 00:06:15.793
Did she ultimately pass away?

00:06:15.793 --> 00:06:16.696
She did.

00:06:16.696 --> 00:06:22.456
That was at 2.05pm on the 4th of August 2023.

00:06:22.456 --> 00:06:25.562
And now we're moving on to Ian Wilkinson.

00:06:26.665 --> 00:06:30.132
He also arrived at the Austin Hospital on the 1st of August.

00:06:30.132 --> 00:06:34.240
He was the fourth of the patients to arrive.

00:06:34.240 --> 00:06:36.363
Yes, he was the fourth and the last.

00:06:36.363 --> 00:06:45.201
Did you receive a similar clinical history for Ian Wilkinson's presentation as you'd done for Don Gail and Heather?

00:06:45.201 --> 00:06:48.372
Yes, it was very similar for Ian.

00:06:48.372 --> 00:06:54.725
He had also been to Leangatha Hospital, that's correct.

00:06:54.725 --> 00:06:56.954
On the 4th of August.

00:06:56.954 --> 00:06:59.560
He underwent a surgical procedure that day.

00:07:00.550 --> 00:07:09.177
We were worried that there might be an involving intra-abdominal catastrophe, such as ischemic bowel or a deep gut.

00:07:09.177 --> 00:07:15.535
Was undertaken to assess that and what diagnostic procedure was performed?

00:07:15.535 --> 00:07:17.600
Correct and what did you find?

00:07:17.600 --> 00:07:23.122
No significant bowel pathology, no significant abnormalities in the bowel.

00:07:23.122 --> 00:07:31.274
How did Ian's condition change over the next few days the 5th, the 6th and the 7th of August?

00:07:31.274 --> 00:07:35.675
There was some slow but important improvement over the next couple of days.

00:07:35.675 --> 00:07:39.233
Did he continue to improve over the days that followed?

00:07:39.233 --> 00:07:50.514
Yes, it was very slow because he was coming out of an extremely critical illness, but he did slightly improve over that time.

00:07:50.514 --> 00:07:55.814
Yes, was he discharged from the ICU ward on the 21st of August?

00:07:55.814 --> 00:08:08.512
Yes, he was discharged to a rehab ward at Heidelberg Repatriation Hospital on the 11th of September and he was eventually discharged home.

00:08:08.512 --> 00:08:13.812
Yes, how close did Ian Wilkinson come to dying?

00:08:13.812 --> 00:08:16.038
We thought he was going to die.

00:08:16.038 --> 00:08:23.898
It's very close and Ian was actually given a liver transplant as well, like Don.

00:08:23.898 --> 00:08:29.494
So now we're moving on to Gail's treatment.

00:08:29.533 --> 00:08:30.716
July 31,.

00:08:30.716 --> 00:08:39.025
Her condition deteriorated July 31.

00:08:39.025 --> 00:08:39.908
Her condition deteriorated severely.

00:08:39.908 --> 00:08:40.428
By the 1st of August.

00:08:40.428 --> 00:08:41.149
She was rapidly deteriorating.

00:08:41.149 --> 00:08:49.198
She had was in an advanced state of organ failure, with her organs essentially shutting down and she was in a state of advanced shock, as they did for Donald.

00:08:49.198 --> 00:09:01.100
Did commissions commence some additional treatments for Gail at the time, including vitamin C and the plasma exchange?

00:09:01.100 --> 00:09:01.865
Yes, that's correct.

00:09:05.164 --> 00:09:06.167
Again, they're asking about the 2nd of August.

00:09:06.167 --> 00:09:09.491
She remained extremely unwell to the point where, from a clinical perspective, her liver essentially was not working at all.

00:09:09.491 --> 00:09:12.537
Did she continue to have watery diarrhea?

00:09:12.537 --> 00:09:14.120
She did at the time, I believe.

00:09:14.120 --> 00:09:19.212
Did she continue to receive maximal treatment and therapy?

00:09:19.212 --> 00:09:20.235
She did.

00:09:20.235 --> 00:09:22.479
She was on everything we had.

00:09:22.479 --> 00:09:28.080
Yes, did they consider an emergency liver transplant for Gail?

00:09:28.080 --> 00:09:36.227
There was a lot of discussion about whether it was possible to undertaking her, given the advanced state of her multiple organ failure.

00:09:36.227 --> 00:09:58.413
So it was considered yes, but she ultimately did not have a liver transplant the view, the consensus of opinion of all the experts and at dandy nong it became apparent she was developing an acute liver injury which is so sick, which is why she was transferred to the Austin as well.

00:09:59.636 --> 00:10:00.961
On the 3rd and 4th of August.

00:10:00.961 --> 00:10:03.346
Gail's condition continued to decline?

00:10:03.346 --> 00:10:06.429
Yes, she progressively became further unwell.

00:10:06.429 --> 00:10:14.298
Gail ultimately passed away at 5.55pm on August 4, 2023.

00:10:14.298 --> 00:10:22.976
What we heard there in that sample from the transcript was a devastating and chilling account from the law courts at Morwell.

00:10:22.976 --> 00:10:24.326
Thank you for listening.

00:10:24.326 --> 00:10:31.259
