00:00:00.200 --> 00:00:02.786
Welcome to the Mushroom Murder Trial Podcast.

00:00:02.786 --> 00:00:07.073
I'm Lisa and I've been tracking this case since 2023.

00:00:07.073 --> 00:00:14.814
Most weekdays, we deliver detailed coverage of one of Australia's most closely watched legal dramas.

00:00:14.814 --> 00:00:23.449
Here's everything you need to know from last week's Supreme Court of Victoria hearings in Morwell.

00:00:23.449 --> 00:00:32.305
Quick reminder if you haven't signed up to our newsletter, it's at mushroommurdertrialcom.

00:00:32.305 --> 00:00:35.392
You get exclusive things breakdowns.

00:00:35.392 --> 00:00:41.487
I'm going to expand it, so please get there and subscribe so you don't miss an edition.

00:00:41.487 --> 00:00:47.234
Now we'll just quickly go into the case background and the legal disclaimers.

00:00:48.200 --> 00:00:53.552
The defendant is Erin Trudy Patterson, age 50, of Leongatha, victoria.

00:00:53.552 --> 00:01:03.432
The charges are three counts of murder and one count of attempted murder, and the plea is not guilty to all charges.

00:01:03.432 --> 00:01:10.462
The plea is not guilty to all charges.

00:01:10.462 --> 00:01:17.355
As we know, there was a tragic family lunch on the 29th of July 2023, where she served a homemade beef wellington containing the deadly toxins.

00:01:17.355 --> 00:01:25.174
Now, today is Science with Lisa, and it's also Appalling Pronunciation with Lisa, so you have to bear with me.

00:01:25.174 --> 00:01:39.793
Okay, apparently, the court was told well, I heard it that Beef Wellington contained the deadly toxins from the Amanita filates, commonly known as the death cap mushroom.

00:01:39.793 --> 00:01:50.734
Now, within days, three family members died Don and Gail Patterson, both aged 70, and Heather Wilkinson, aged 66.

00:01:50.734 --> 00:02:00.114
Heather's husband, ian Wilkinson, fell critically ill but survived after an extended stay in intensive care.

00:02:00.114 --> 00:02:17.037
This trial is gripping the nation not only because of the tragic loss of life, but due to the, I tell you, the scientific complexities surrounding mushroom toxins, compounded by the questions about how samples were handled and analysed.

00:02:18.099 --> 00:02:22.532
Now, firstly, on Thursday a juror was removed.

00:02:22.532 --> 00:02:29.260
Day a juror was removed.

00:02:29.260 --> 00:02:33.911
Justice Christopher Beale formally discharged a juror amid allegations he had discussed the case details outside the jury room with friends and family.

00:02:33.911 --> 00:02:44.937
The bench had operated under a reporting ban until late Thursday, which is now listed, and we can talk about what happened Now.

00:02:44.937 --> 00:03:02.245
Justice Beale found a quote, reasonable possibility that the juror's conduct could have compromised confidentiality, so he stopped short of declaring actual misconduct, but his honour reminded the remaining jurors.

00:03:02.245 --> 00:03:10.088
I want to remind you of my directions you should only discuss the case with your fellow jurors in the privacy of the jury room.

00:03:10.088 --> 00:03:13.741
Any breach risks the integrity of these proceedings.

00:03:13.741 --> 00:03:16.883
So the juror was sent home.

00:03:19.606 --> 00:03:27.819
Now here's our toxicology deep dive Victoria's chief toxicologist, dr Dimitri Gerastamoulos.

00:03:27.819 --> 00:03:31.550
What can I say?

00:03:31.550 --> 00:03:36.703
I'm an animal, dr Dimitri Gerastamoulos, that's it.

00:03:36.703 --> 00:03:37.625
I'm sorry.

00:03:37.625 --> 00:03:39.268
My pronunciation's terrible.

00:03:39.268 --> 00:03:41.712
Spent two days on the stand this week.

00:03:42.093 --> 00:03:45.806
His testimony pivoted on chemical assays.

00:03:45.806 --> 00:03:47.531
Now I'll look these up for you.

00:03:47.531 --> 00:04:01.977
That's the testing of metal or ore to determine its ingredients and quality, detecting alpha and beta aminotins, the protein synthesis inhibitors responsible for liver failure.

00:04:01.977 --> 00:04:09.734
So, as we know, two of the lunch attendees had situations with their liver.

00:04:09.734 --> 00:04:16.567
Now there were also the bin samples, scraps of the beef, wellington and mushroom paste.

00:04:16.567 --> 00:04:21.375
They were seized from Ms Patterson's outside bin by police.

00:04:21.375 --> 00:04:31.517
These tests were conducted roughly one month after the July lunch, demonstrating that toxins can persist in food debris longer than previously thought.

00:04:31.517 --> 00:04:49.257
Now, human samples blood and urine from Ms Patterson taken on the 31st of July showed no traces of amanitans, suggesting she either did not ingest the mushrooms or that detection windows vary by individual metabolism.

00:04:50.305 --> 00:05:10.192
The highly toxic amatoxins found only in death cap mushrooms, including alpha-amitin and beta-amitin, were detected in urine samples provided by one of the victims, and that was Don Patterson, when he was at Dandenong Hospital.

00:05:10.192 --> 00:05:18.853
There'd also been positive results from Ian Wilkinson's blood serum and urine from the beta-amitin toxin.

00:05:18.853 --> 00:05:22.077
I'm really stuffing that up.

00:05:22.077 --> 00:05:23.338
I'll try better.

00:05:23.338 --> 00:05:29.028
Okay Now, don and Ian both registered significant toxin levels.

00:05:29.028 --> 00:05:44.718
Conversely, post-mortem analyses of Gail Patterson and Heather Wilkinson those showing advanced liver damage consistent with poisoning returned negative for detectable amanitins Under cross-examination.

00:05:44.718 --> 00:05:48.170
The expert conceded that sample timing is critical.

00:05:48.170 --> 00:05:57.112
Evidence of toxins degrade over time and the ideal sampling occurs within 24 to 36 hours of ingestion.

00:05:57.112 --> 00:06:11.278
He also confirmed that combining leftovers from two different collection points into one evidence bag was not procedural breast practice, potentially complicating chain of custody questions.

00:06:12.144 --> 00:06:17.461
The toxicologist was quizzed by Mr Mandy SC that's Colin Mandy.

00:06:17.461 --> 00:06:23.696
He's Erin's barrister on the estimated fatal dose of the amatoxins found in death cap mushrooms.

00:06:23.696 --> 00:06:27.791
He said it was about one milligram per kilogram of body weight.

00:06:27.791 --> 00:06:38.399
So it's a quote, very small amount, but he told the jury that for a 70 kilo adult a lethal dose was about 50 grams or three tablespoons.

00:06:38.399 --> 00:06:48.540
But he agreed variables could affect whether a dose was lethal, such as age, weight, health care received and the toxic response of an individual.

00:06:50.367 --> 00:06:52.254
Next we had Dr David Lovelock.

00:06:52.254 --> 00:06:59.913
He's now the Diagnostics Manager at Plant Health Australia and he provided additional analysis.

00:06:59.913 --> 00:07:12.095
He detailed how he received multiple food items in August 2023, ranging from gravy in Ziploc bags to fragments from a home dehydrator.

00:07:12.095 --> 00:07:21.975
In terms of the beef wellington DNA, the only common button mushroom DNA, was identified.

00:07:21.975 --> 00:07:41.468
Now, with the dehydrated debris, genetic sequencing returned a 99% match to Amanita falades, strongly suggesting that death cat mushrooms had been processed in the dehydrator prior to the fatal meal, allegedly.

00:07:41.468 --> 00:07:59.286
Dr Lovelock said analysis of the seven vials he'd received found two of the seven dehydrator samples contained material genetically identified as death cat mushroom.

00:07:59.286 --> 00:08:06.120
We were able to detect Amanita filatus in two of the seven test tubes.

00:08:06.120 --> 00:08:15.779
The genetic code we got out of those two samples was more than 99% similar to a reference sample of Amanita filatis.

00:08:17.642 --> 00:08:23.593
Amid the science, there was emotional testimony at which added some human texture to the trial.

00:08:23.593 --> 00:08:32.686
Child protection worker Katrina Cripps spoke of interviewing Ms Patterson at her Lee and Gaffer home on August 2, 2023.

00:08:32.686 --> 00:08:41.965
The mother of two said she had aimed to cook something quote new and special for her extended family.

00:08:41.965 --> 00:08:48.903
She followed a recipe Tin Eats Beef Wellington recipe which has come up before.

00:08:48.903 --> 00:08:49.744
That's the book.

00:08:49.744 --> 00:08:51.735
I had a look at it the other day.

00:08:51.735 --> 00:08:53.456
Some of the recipes look amazing.

00:08:54.370 --> 00:09:00.503
Now Ms Cripps also recounted Ms Patterson's account of her strained marriage to Simon Patterson.

00:09:00.503 --> 00:09:05.822
According to the witness, erin expressed feeling isolated.

00:09:05.822 --> 00:09:14.960
Simon had become quote distant and was allegedly restricting her access to his parents, her primary emotional support.

00:09:14.960 --> 00:09:22.022
She, quote, felt that he was isolating her from his family, the child protection worker said.

00:09:22.022 --> 00:09:41.225
Ms Cripps added Ms Patterson had told her a quote about feeling like in brackets Simon was controlling and emotionally abusive, allegedly in that he would say things to her that would make her doubt herself as a parent, as a mother, and it would impact her self-esteem.

00:09:41.225 --> 00:09:56.823
She also told Ms Cripps about hosting her parents-in-law for lunch with her children earlier in 2023, and she'd invited them because quote she just wanted to reconnect with them and see them.

00:09:58.192 --> 00:09:59.015
So what's next?

00:09:59.015 --> 00:10:04.902
The trial's resuming tomorrow, with further expert witnesses scheduled to appear.

00:10:04.902 --> 00:10:13.057
We'll continue to track every debate, legal manoeuvre and witness account as this case heads towards closing arguments.

00:10:13.057 --> 00:10:17.212
We don't have a date on that yet, so stay tuned.
