00:00:46.331 --> 00:01:00.774
During his third day of giving evidence, simon Patterson, erin Patterson's husband, faced further scrutiny in the Supreme Court trial of his estranged wife, who stands accused of three murders and one attempted murder.
00:01:00.774 --> 00:01:10.974
Miss Erin Trudy Patterson, aged 50, from Leongatha, is pleading not guilty to three charges of murder and one of attempted murder.
00:01:10.974 --> 00:01:29.096
She is accused but denies deliberately serving a meal containing deadly death cap mushrooms to her former in-laws and their relatives during a lunch at her home in Leangatha on July 29, 2023.
00:01:29.096 --> 00:01:36.212
Don and Gail Patterson, aged both 70, and Gail's sister, 66, later died.
00:01:36.212 --> 00:01:40.984
Heather's husband, ian Wilkinson, became critically ill but survived.
00:01:41.745 --> 00:01:53.352
Three women Ms Patterson, befriended via a true crime group, gave evidence in the Supreme Court of Victoria about their interactions online with the teaching student.
00:01:53.352 --> 00:02:01.450
Quote according to Ms Jenny Hafe, a social work lecturer from Tasmania quote.
00:02:01.450 --> 00:02:06.588
Originally we met through a Facebook group that was about Kelly Lane.
00:02:06.588 --> 00:02:09.104
That stemmed from the ABC documentary.
00:02:09.104 --> 00:02:12.069
She said that was a pretty big group.
00:02:12.069 --> 00:02:14.294
Eventually that fell apart.
00:02:14.294 --> 00:02:19.028
I was also then in a group with about 20 people in that group.
00:02:19.028 --> 00:02:23.087
Then there were about five of us in a group chat together.
00:02:23.087 --> 00:02:28.225
I think we had just become closer friends and just wanted to have our group.
00:02:28.225 --> 00:02:29.709
That was just ours.
00:02:29.709 --> 00:02:31.532
It was the beginning of COVID.
00:02:31.532 --> 00:02:40.061
So there was a lot of talk about COVID, everyday life, family, friends, events, whatever was going on in our lives.
00:02:40.882 --> 00:02:44.165
In one message shown to the court from the time before the lunch.
00:02:44.165 --> 00:02:52.556
In one message shown to the court from the time before the lunch, ms Patterson allegedly wrote I've been hiding powdered mushrooms in everything, mixed it with chocolate brownies.
00:02:52.556 --> 00:03:03.341
Yesterday the kids had no idea.
00:03:03.341 --> 00:03:07.068
Ms Patterson also allegedly posted photos of the Sunbeam Food Lab electronic dehydrator to this chat group with her friends.
00:03:07.068 --> 00:03:13.867
One photo shown to the jury demonstrated mushrooms on the dehydrator's shelves.
00:03:13.867 --> 00:03:17.794
Another showed chopped up button mushrooms.
00:03:17.794 --> 00:03:22.069
She seemed to really like mushrooms, jenny Hay told the court.
00:03:22.069 --> 00:03:23.753
According to Ms Hay.
00:03:24.536 --> 00:03:29.165
Erin Patterson bought the food dehydrator in early 2023.
00:03:29.165 --> 00:03:30.228
Quote.
00:03:30.228 --> 00:03:35.042
I remember her making mushroom soups and blitzing them so the kids would eat them.
00:03:35.042 --> 00:03:37.343
She seemed to use it a lot.
00:03:37.343 --> 00:03:43.622
A short time later, ms Patterson sent another message which was shown to the jury.
00:03:43.622 --> 00:03:50.094
Quote so, fun fact, the dehydrator reduces the mushroom mass by 90%.
00:03:50.094 --> 00:04:00.406
Do you think, woolies, a supermarket would mind if I bought the dehydrator into their vegetable section and dry things before buying them?
00:04:00.406 --> 00:04:11.633
Ms Hayes said her friend never discussed foraging mushrooms but there were many discussions inside the group about preparing and making food.
00:04:11.633 --> 00:04:20.576
She said Ms Patterson messaged the group towards the end of July 2023 seeking recipe advice for a beef wellington.
00:04:20.576 --> 00:04:21.807
Quote.
00:04:21.807 --> 00:04:25.701
She was at a supermarket in brackets.
00:04:25.701 --> 00:04:32.257
She said close black brackets, something about meat, because she was making a beef wellington, miss hay said.
00:04:32.257 --> 00:04:42.773
She added she spoke to miss patterson on the phone sometime after the lunch and she said she bought the mushrooms from an asian grocer.
00:04:42.773 --> 00:04:54.990
Ms Hay, who had cooked beef Wellington before and described it in court as one of her favourite dishes, said she gave advice to Patterson about how to make sure it wasn't soggy.
00:04:55.651 --> 00:05:11.237
Another person who knew Erin was Daniela Barclay and another Christine Hunt, and they testified that Miss Patterson complained on several occasions about her estranged husband, simon.
00:05:11.237 --> 00:05:21.959
Miss Hunt said Miss Patterson painted her husband a devout Christian as quote coercive and quote abusive.
00:05:21.959 --> 00:05:27.786
Miss Hunt said Miss Patterson in her belief was an atheist Quote.
00:05:27.786 --> 00:05:33.875
She was saying to us publicly in that group that she didn't necessarily believe in God, she said.
00:05:33.875 --> 00:05:39.036
Ms Barkley said that Ms Patterson's life revolved around her children.
00:05:39.036 --> 00:05:42.514
I thought she was a wonderful mother, she said.
00:05:42.514 --> 00:06:07.971
Earlier in the day Ms Patterson's lawyer, colin Mandy SC, also questioned Mr Patterson about a conversation he had with the accused at Monash Medical Centre where she allegedly told him she'd done a blind taste test involving their daughter and muffins made with mushrooms from a dehydrator, according to Mr Mandy.
00:06:07.971 --> 00:06:12.178
Simon then asked Erin, is that what you use to poison them?
00:06:12.178 --> 00:06:14.230
Referring to the kitchen device.
00:06:14.230 --> 00:06:19.225
This exchange reportedly took place two days after the fatal lunch.
00:06:19.225 --> 00:06:22.351
Mr Patterson firmly denied that claim.
00:06:22.351 --> 00:06:32.365
I did not say that to Erin, she said no clarification was offered in the court regarding who exactly Mandy was referring to as quote them.
00:06:33.247 --> 00:06:45.976
Mr Patterson was in the witness stand for the third day and Crown Prosecutor Nanette Rogers focused on a series of messages sent by his estranged wife.
00:06:45.976 --> 00:06:59.533
He told the court that his mother affected by a recent encephalitis diagnosis had agreed not to read certain messages from Erin in order to manage her anxiety.
00:06:59.533 --> 00:07:12.439
One particular message described by Simon as quote inflammatory was sent a few months after the court had earlier reviewed messages from December 2022.
00:07:12.439 --> 00:07:21.059
Recalling the context, mr Patterson said his son had been extremely tired during a visit with him.
00:07:21.059 --> 00:07:26.588
In response, he asked Ms Patterson to help ensure their child went to bed earlier.
00:07:26.588 --> 00:07:36.492
She allegedly replied in their group chat on the messaging app called Signal, which included both of Simon's parents.
00:07:36.492 --> 00:07:45.014
In relation to his father's reply, he said I tell you what if mum had read that?
00:07:45.014 --> 00:07:47.968
I don't know what we would have done to her, he said.
00:07:47.968 --> 00:08:00.646
When asked to clarify what he meant by inflammatory, he explained it was having a crack at me and accusing me of some things in response to what I'd messaged her about.
00:08:00.646 --> 00:08:02.992
That's not the bit I objected to.
00:08:02.992 --> 00:08:09.175
It was the fact that she sent it, especially knowing my mum's condition and what that can do to mum.
00:08:09.175 --> 00:08:11.026
I'm still upset about that.
00:08:11.026 --> 00:08:16.877
Later, mr Mandy completed his cross-examination of Mr Patterson.
00:08:16.877 --> 00:08:23.754
He pointed out that the messages presented were the only ones concerning school fee payments.
00:08:23.754 --> 00:08:40.239
Note this was a second set of messages referred to by Mr Patterson, the court was read more encrypted signal messages exchanged in the family group chat involving Erin, simon, his father and his mother, gail.
00:08:41.004 --> 00:08:48.692
The messages followed Don's suggestion that he catch up with the family before Erin took their two children on a trip to New Zealand.
00:08:48.692 --> 00:09:03.865
In a message sent at 8pm on December 5, erin referred to Simon's 2022 tax return, which indicated he was separated, and linked it to child support and government benefits.
00:09:03.865 --> 00:09:04.855
Quote.
00:09:04.855 --> 00:09:14.686
I'm sorry but I can't stop thinking about the comment that Don made on the phone that Simon can reverse the whole single thing in his tax return.
00:09:14.686 --> 00:09:15.226
She wrote.
00:09:15.226 --> 00:09:18.544
That is mind boggling in its implication.
00:09:19.235 --> 00:09:26.868
Erin claims she might miss out on $15,000 annually from the family tax benefit due to Simon's declaration.
00:09:26.868 --> 00:09:36.701
We were basically lying to the government, telling them that we were a family with shared finances so they wouldn't make him pay child support.
00:09:36.701 --> 00:09:49.658
She said I would have been entitled to about $30,000 a year in child support from Simon, but I didn't claim it because I foolishly trusted him to do the right thing by me and the kids.
00:09:49.658 --> 00:09:55.677
The court heard she also accused Simon of wanting to be a quote bare minimum parent.
00:09:55.677 --> 00:10:03.240
Roughly an hour after this message, don replied saying he was sorry if he misrepresented Simon's intentions.
00:10:04.081 --> 00:10:15.337
The following day Erin continued the discussion, saying she respected the family's desire not to intervene but would keep sharing messages on what she viewed as important matters.
00:10:15.337 --> 00:10:27.397
Quote I would hope that you, as his parents, would be concerned that he was making the decisions that are in the best interests of the children and not operating from a place of being angry.
00:10:27.397 --> 00:10:29.321
To that end, she wrote.
00:10:29.321 --> 00:10:32.287
Mr Mandy asked Simon if he agreed.
00:10:32.287 --> 00:10:37.224
The messages showed Erin was seeking his parents' support and that they were hesitant.
00:10:37.224 --> 00:10:38.827
Simon confirmed this.
00:10:38.827 --> 00:10:55.124
The jury also heard about Erin's previous community involvement in Corrumburra, with Simon acknowledging she had assisted his parents in the development association and took over the running of the Borough Flyer, the town newsletter.
00:10:55.124 --> 00:10:59.566
Simon regularly contributed photographs for the publication as well.
00:11:00.414 --> 00:11:15.178
Last week Prosecutor Nanette Rogers SC told the court that Erin allegedly invited the guests under the pretext of discussing a cancer diagnosis and claimed she used this story to explain the absence of her children at the gathering.
00:11:15.178 --> 00:11:24.964
But Mr Mandy, for the defence, told the court that Erin does not deny the present of deadly mushrooms but insists it was unintentional.
00:11:24.964 --> 00:11:32.405
The defence case is that Erin Patterson did not deliberately serve poisoned food to her guests.
00:11:32.405 --> 00:11:34.696
The defence case is that it happened.
00:11:34.696 --> 00:11:37.500
It was a tragedy, a terrible accident.
00:11:37.500 --> 00:11:44.942
Justice Christopher Beale is presiding over this trial in the La Trobe Magistrates Court in Morwell.
00:11:44.942 --> 00:11:50.441
